By submitting your payment information, you authorize Dog & Whistle to charge the applicable amounts to your payment method at the time of purchase and at the start of each subsequent subscription period. Your subscription will automatically renew at the end of each period unless you cancel in accordance with our Cancellation Policy.
You must maintain a valid, up-to-date payment method to start and maintain your subscription. If your primary payment method fails (for example, due to expiration, insufficient funds, or other processing issues), we may attempt to charge any eligible backup payment method associated with your account. If a backup payment is successful, it will automatically become your primary payment method for future orders. You may update your payment information at any time through your account settings.
Dog & Whistle reserves the right to suspend or terminate your subscription if payment cannot be successfully processed. An order will not be fulfilled until payment has been received and confirmed.
You may adjust your meal plan selections, portion sizes, delivery frequency, or delivery dates at any time through your online account. Changes made before your next scheduled processing date will take effect on that order. Changes made after the processing date will apply to the following order.
We may limit order quantities per person, household, or order at our discretion. If we modify or cancel an order, we will make reasonable efforts to notify you using the contact information associated with your account. You agree to provide accurate, current, and complete purchase and billing information at all times.

Arbitration will be conducted in Clark County, Nevada. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Neither party may bring claims as a plaintiff or class member in any class action, class arbitration, or representative proceeding. Each party waives the right to a jury trial.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
You agree to defend, indemnify, and hold harmless Dog & Whistle Corp., its officers, directors, employees, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the site or services; (b) your violation of these Terms; or (c) your infringement of any third party’s rights.

FOR ANY LOSS OR DAMAGE NOT EXCLUDED UNDER THESE TERMS, THE TOTAL CUMULATIVE LIABILITY OF DOG & WHISTLE CORP. SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DOG & WHISTLE IN THE 90 DAYS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Dog & Whistle reserves the right to suspend or terminate your access to the site or services at any time, with or without notice, for any reason — including if we believe you have violated these Terms. Upon termination, all rights and licenses granted to you will immediately cease. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and dispute resolution) will remain in effect.
